Land Registration and the Legal Services Act 2007
The Land Registry seeks views on proposed changes to the following legislation:
- Land Registration Rules 2003 (SI 2003/1417)
- The Land Registration (Network Access) Rules 2008 (SI 2008/1748)
- Land Registration (Proper Office) Order 2010 (SI 2010/1635)
The Land Registry has launched a consultation on amendments required to the land registration legislation to make it consistent with the changes being introduced by the Legal Services Act 2007 (LSA 2007). The LSA 2007 provides for the introduction of alternative business structures which will come into existence with the proposed implementation of Part 5 of the LSA 2007 in October 2011. The aim of the LSA 2007 is that consumers will have access to a wider range of licensed legal service providers.
The Land Registry propose amending the definitions of “conveyancer” and the persons entitled to make electronic applications to the Land Registry, so that these are consistent with the persons authorised to provide conveyancing services under the LSA 2007.
The consultation paper lists the detailed draft amendments and contains explanatory notes on each of the proposals.
Responses can be submitted online, by post or by DX. The closing date is Monday 28 February 2011.
The Mortgage Repossessions (Protection of Tenants etc) Act 2010
This act has now received Royal Assent and aims to tackle the problem of tenants being evicted at short notice when their home is repossessed by their landlord’s lender. Where a landlord grants an unauthorised tenancy after the date of the mortgage, a tenant may not be aware of repossession proceedings by the landlord’s lender and have little time to find a new home. The Act:
- Gives courts the power to postpone an order for delivery of possession (and to stay or suspend the execution of a possession order) for up to two months.
- Requires the lender to give notice, at the property, of the proposed execution of the possession order.
New Logo for Barnsley Law Society
We are pleased to announce that The Barnsley Law Society has adopted a new logo. In order to allow for the Society to get involved with the locals, it was agreed that the Barnsley College’s Media Department would design a logo and the winner would receive £100 worth of vouchers from Meadowhall. The winner of the competition was Becky Wake and the vouchers were presented by the President, Sally Osborn and Treasurer, Sam Price at the College. We would like to say a big thank you to all those students who took part in the event.
Barnsley County Court to stay open
We are pleased to confirm that Barnsley County Court will be moving to the Magistrates Court. Further details will follow. We would like to thank all members and solicitors for their involvement in replying to the consultation, which received a substantial number of replies in response to the consultation with regards to the potential closure of the Court.
Society launches new website
